1. Introduction

Ovlivionmkt ("we," "us," or "our") is a creative and marketing company offering video production, photography, social media management, creative direction, branded content, and related production services. Our website is located at https://ovlivionmkt.com/ (the "Site").

This Privacy Policy explains what information we collect when you visit our Site or contact us, how we use it, how we protect it, and what rights you have in relation to it.

By using our Site, you agree to the practices described in this policy. If you do not agree, please do not use the Site. If you have questions at any time, the contact information at the bottom of this page is the best place to start.

The short version: We collect only what we need. We do not sell your information. We do not send unsolicited marketing. We do not build advertising profiles. You can ask us to delete your information at any time.

2. Information we collect

We collect two types of information: information you provide to us directly, and information collected automatically when you use the Site. We do not collect sensitive personal information such as government IDs, financial account numbers, health data, or biometric data.

The categories below describe each type in detail.

3. Information you provide through contact forms

When you fill out a contact form on our Site, we collect the information you choose to submit. This typically includes your name, email address, and the content of your message. You may also choose to include a phone number, company name, or other details.

We use this information solely to respond to your message. We do not add you to email lists, newsletters, or marketing sequences without your explicit consent. Submitting a contact form does not constitute an opt-in to any ongoing communications.

4. Project inquiry information

When you contact us about a potential project, we collect information related to that inquiry. This may include your name, organization, contact details, project description, timeline, budget range, and any reference materials or files you choose to share.

This information is used to evaluate the project, respond to your inquiry, and prepare any related proposals or estimates. It is not disclosed to third parties unless that is necessary to respond to your request or fulfill a project you have formally contracted with us to deliver.

Any proposals, estimates, or creative concepts shared by Ovlivionmkt in response to your inquiry are confidential and proprietary to Ovlivionmkt. You agree not to share, distribute, or act on such materials without our written consent.

5. Email and communication data

If you contact us directly by email or phone, we retain those communications as part of our normal business records. This includes the content of emails and any attachments you send. We may retain records of phone conversations for internal reference where applicable.

We do not use communication data for advertising and we do not share it with data brokers, marketing platforms, or third-party analytics providers.

6. Website analytics and cookies

Our Site may use analytics tools to understand how visitors use the Site. These tools may automatically collect information such as your IP address (which may indicate approximate geographic location), browser type, device type, operating system, pages visited, time spent on the Site, and referring pages. This data is used in aggregate to improve the Site and is not linked to your personal identity.

Cookies are small text files placed on your device when you visit the Site. We use cookies for basic site functionality and, where analytics tools are in use, to understand usage patterns. You can adjust your browser settings to block or delete cookies at any time. Blocking certain cookies may affect how parts of the Site function.

For full detail on the types of cookies we use and how to manage your preferences, see our Cookie Notice.

7. How we use information

We use the information we collect to:

  • Respond to your messages, questions, or project inquiries
  • Prepare and deliver proposals, estimates, or project-related materials
  • Communicate with existing or prospective clients about ongoing or potential work
  • Maintain business records in accordance with standard accounting and legal requirements
  • Improve how our Site functions and how we present our services
  • Comply with applicable legal obligations, including any lawful government or court requests

We do not use your information for targeted advertising, behavioral profiling, or any purpose not described in this policy without first obtaining your consent.

Where applicable law requires a legal basis for processing, we rely on the following: performance of a contract or pre-contractual steps (for project inquiries and client work), legitimate interests (for analytics and website improvement), and legal obligation (for record-keeping and compliance).

8. How information may be shared

We do not sell, rent, or trade your personal information. We do not share it with advertising networks or data brokers. We may share it only in the following limited circumstances:

  • Service providers: We work with a small number of trusted vendors to operate our business, including email platforms, cloud storage, and project management tools. These providers process information on our behalf and are required to handle it securely and in accordance with applicable law. They are not permitted to use your information for their own purposes.
  • Production collaborators: On active projects, we may share relevant project information with contracted crew members, editors, or other production professionals working directly on your project. This is done only to the extent necessary to complete the agreed work and is subject to confidentiality obligations.
  • Business transfers: In the event of a merger, acquisition, or sale of all or part of our business, personal information may be transferred as part of that transaction. We will notify affected individuals as required by law.
  • Legal and regulatory requirements: We may disclose information if required by law, valid court order, government subpoena, or other lawful legal process. Where permitted, we will attempt to notify you before complying with such a request.
  • Protection of rights: We may disclose information when we believe in good faith that doing so is necessary to protect the rights, property, or safety of Ovlivionmkt, our clients, or the public.

9. Third-party tools and platforms

Our Site and business operations use third-party platforms and services that maintain their own privacy policies. These may include cloud storage providers, file transfer services, video hosting platforms, email platforms, and analytics tools. Examples include but are not limited to Google Analytics, Vimeo, and cloud storage services.

We are not responsible for the privacy practices of third-party services. When you interact with a third-party platform through our Site or in connection with a project, their terms and privacy policies apply independently. We encourage you to review those policies directly.

We do not permit any third-party service to use information collected through our Site for their own advertising or profiling purposes.

10. Client project files and submitted materials

In the course of delivering a project, clients may share files, assets, branding materials, talent releases, scripts, or other materials with us. These materials are used exclusively for the purpose of completing the agreed scope of work. We do not publish, license, or distribute client-provided materials without written authorization.

After project completion, we may retain production files as part of our internal archive. If you have questions about the retention or deletion of specific project materials, please contact us directly and we will respond in good faith.

11. Data retention

We retain different types of information for different periods of time, based on why the information was collected and any applicable legal requirements:

  • Contact and general inquiry data: Retained for up to 24 months. If no project results from an inquiry within that period, we will not hold the information indefinitely. You may request deletion at any time.
  • Active client and project records: Retained for the duration of the engagement and for a minimum of 5 years afterward, consistent with standard business and tax record-keeping requirements in Texas.
  • Analytics data: Retained in accordance with the data retention settings of the analytics platform in use. Aggregate usage data may be retained longer as it is not linked to individuals.
  • Communication records: Email and phone communication history may be retained for up to 3 years or as long as reasonably necessary to support an active or prior business relationship.

You may request deletion of your personal information at any time by contacting us. We will honor reasonable deletion requests to the extent we are not legally required to retain the data. We will respond to deletion requests within 30 days.

13. California residents

If you are a California resident, the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) give you additional rights regarding your personal information.

Under California law, you have the right to:

  • Know the categories of personal information we collect and the purposes for which it is used
  • Access the specific personal information we have collected about you

To submit a California privacy rights request, contact us at contact@ovlivionmkt.com. We will respond within 45 days as required by law. You may designate an authorized agent to submit a request on your behalf, provided you supply written authorization or a valid power of attorney.

14. Do Not Track

Some browsers offer a "Do Not Track" (DNT) setting that sends a signal to websites requesting that your browsing activity not be tracked. There is currently no uniform industry standard for how websites should respond to DNT signals. Our Site does not currently change its behavior in response to DNT signals. If this changes, this policy will be updated accordingly.

15. Security

We take information security seriously. The measures we maintain include:

  • Limiting access to personal information on a strict need-to-know basis
  • Using encrypted file storage and secure transfer protocols where applicable
  • Using reputable third-party platforms that maintain their own security certifications
  • Reviewing and updating our security practices as tools and standards evolve

No system of data storage or transmission is completely secure. We cannot guarantee that information you provide will never be accessed, disclosed, or altered by unauthorized parties. If you have reason to believe the security of information you shared with us has been compromised, please contact us immediately at contact@ovlivionmkt.com.

16. Data breach notification

In the event of a confirmed data security breach that may compromise your personal information, we will notify affected individuals in accordance with the applicable laws of the State of Texas (Texas Business and Commerce Code, Chapter 521) and any other applicable state or federal notification requirements. Notification will be provided in a timely manner and will include, to the extent known, the nature of the breach, the type of information involved, and steps you can take to protect yourself.

17. Children's privacy

Our Site is not directed at children under the age of 13. We do not knowingly collect personal information from anyone under that age. If you are a parent or guardian and believe a child under 13 has submitted personal information through our Site, please contact us immediately at contact@ovlivionmkt.com and we will delete the information promptly.

Our services are intended for businesses and adult professionals. We do not produce content directed at children and do not market to minors.

Our Site may contain links to external websites, social media profiles, platforms, or third-party content. Clicking those links will take you away from our Site. We have no control over the content, privacy practices, or security of external sites, and this Privacy Policy does not apply to them.

The presence of a link on our Site does not constitute an endorsement or recommendation of the linked site. You access external sites at your own risk. We encourage you to review the privacy policy of any site you visit through a link on our Site.

19. Updates to this policy

We may update this Privacy Policy from time to time to reflect changes in our practices, the platforms we use, or applicable law. When we make material changes, we will update the effective date at the top of this page. For significant changes, we may also provide a more prominent notice on the Site.

Continued use of the Site after an updated policy is posted constitutes your acceptance of the revised terms. If you disagree with any changes, please stop using the Site and contact us if you wish to exercise any rights regarding information we hold.
